Employee or Contractor? That is the question!

Hire rightWhen working with numerous SME (small medium enterprises), we are continually asked the question…. Is my Contractor really a contractor??

To correctly work out whether a worker is an employee or contractor, you need to look at the whole working arrangement including the specific terms and conditions under which the work is performed.

You can get an answer about whether your worker is an employee or contractor by using our Employee/contractor decision tool. You need to consider six factors:

  • Ability to sub-contract/delegate;
  • Basis of payment;
  • Equipment, tools and other assets;
  • Commercial risks;
  • Control over work; and/or
  • Independence.

There is no single factor that will be conclusive in determining whether the worker is an employee or contractor. For more information, contact Nicole on 0459 220 516.
